“Edifici Conde de Fenosa”: mediació i participació de l’Administració Pública
Our partner D. Pascual Sala (ex-president of the Supreme Court and the Constitutional Court of Spain) has been appointed as a mediator in a case that had been stuck in the Spanish courts for more than twenty years.
Due to the crucial relevance of the matter, together with Mr. Pascual Sala, the partner of Litigation and Arbitration, Ms. Marlen Estévez, has intervened.
The mediation addresses the execution of a sentence that annulled a building licence and, consequently, agreed to demolish the "Edificio Conde de Fenosa", one of the most popular buildings in A Coruña (Galicia) in which almost one hundred families live. This execution would have been recorded to the City of A Coruña approximately EUR 60m, so it has gone to mediation to explore alternative solutions.
This case is particularly important, not only because of its value, but because it is practically the only case of mediation in Spain in which a Public Administration has agreed to participate, so it opens the doors for the future consolidation of mediation in the public sphere in our country.
