1. ACCESS AND CONDITIONS OF USE OF THE WEBSITE

Access to the Website is free of charge for Users.

Any unauthorised use is prohibited without the prior written authorisation of RocaJunyent.

RocaJunyent reserves the right to deny, suspend, interrupt or cancel access to or use of the Website, in whole or in part, to those Users who fail to comply with any of the conditions set out in this Legal Notice and/or any of the Legal Terms of the Website.

Likewise, RocaJunyent shall have the right to investigate and report any of the aforementioned conducts in accordance with the Law, as well as to collaborate with the authorities in the investigation of such actions.

1.1. Obligation to make proper use of the Website and the Services

You undertake, as a User, to make appropriate use of the Website and the materials, services and forms offered through it, in accordance with the applicable legislation and always for the purposes for which they have been created. 

To this effect, as a User, you shall refrain from using the Website for illicit, prohibited or unauthorised purposes or effects, or for purposes that are harmful to the rights and interests of third parties; or that may in any way damage, render useless, overload, deteriorate or impede the normal use of the Website, the services, computer equipment, documents, files and other content offered by RocaJunyent on the Website and/or that may be stored on any computer equipment belonging to RocaJunyent, other Users or any Internet User (both hardware and software). 

In particular, as a User you undertake to (including, but not limited to):

1. not engage in activities that are unlawful, illegal or contrary to good faith and public order;
2. not cause damage to the physical and logical systems of the website, its suppliers or third parties;
3. not introduce or disseminate computer viruses or any other physical or logical systems that may cause damage to the networks, equipment, systems of the Users, of the Website or of RocaJunyent;
4. not attempt to access, use and/or manipulate the data of RocaJunyent, third party suppliers and/or other Users;
5. not to remove, alter, evade or manipulate any protection device or security system that may be installed in it;
6. not to use robots, data exploration and storage systems (such as spiders or scrapers), hidden links or any other resource, tool, programme, algorithm or automatic data collection/extraction method to access, acquire, copy or monitor the Website, without the express written permission of RocaJunyent;
7. not to use the Services and, in particular, information of any kind obtained through the Website to send advertising, communications for the purposes of direct sales or for any other commercial purpose, unsolicited messages addressed to a number of persons regardless of their purpose, or to market or disclose such information in any way;
8. not impersonate the identity of another person or organisation, use disrespectful or offensive language such as insults, threats or comments that may offend the sensibilities of other users; or present, recommend and/or quote companies or web portals and/or carry out marketing or spamming actions. This type of content will be deleted along with, where appropriate, the accounts that carried out such actions. 

1.2. Obligation to make proper use of the Contents

RocaJunyent reserves the right to remove any content that is disrespectful and/or contravenes the provisions of this section, as well as to take any legal action that may be appropriate.

As a User you undertake to use the content placed at your disposal on the Website, which is understood to include, but is not limited to, the texts, photographs, graphics, files, logos, images, icons, technology, software and links; as well as the selection and form of presentation of the materials included therein and other audiovisual or sound content, its software, graphic design and the source codes necessary for its operation, access and use (the "Content"), in accordance with the law and the Legal Terms of the Website; and, in particular, you shall refrain from:

1. reproduce, copy, distribute, make available or in any other way publicly communicate, transform or modify, or carry out any other form of exploitation, by any procedure, of all or part of the Contents, as well as their design and the selection and form of presentation, unless you have the express authorisation of RocaJunyent or the holder of the corresponding rights or it is legally permitted;
2. decompile, disassemble, reverse engineer, sublicense or transmit in any way, translate or make derivative works of the computer programs necessary for the operation, access and use of the Website and the services contained therein, as well as perform, with respect to all or part of such programs, any of the acts of exploitation described in the preceding paragraph. As a User of the Website, you must refrain in all cases from deleting, altering, evading or manipulating any protection device or security system that may be installed on the Website;
3. delete, manipulate or in any way alter any reservation of rights and other identifying data.

2. INTELLECTUAL AND INDUSTRIAL PROPERTY RIGHTS

The information disseminated on the website, as well as its contents, are owned by RocaJunyent or its authors and are considered protected works in accordance with the provisions of Royal Decree 1/1996 of 12 April, approving the revised text of the Intellectual Property Law. Under no circumstances may it be understood that RocaJunyent grants or authorises Users to exploit in any way whatsoever the rights over said Contents beyond what is strictly necessary for the correct use of the Website.

The trademarks, trade names or distinctive signs of any kind that appear on the website are owned by RocaJunyent or have been published with the consent of their legitimate owners, and it may not be understood that access to the website grants users any rights over the aforementioned trademarks, trade names and/or distinctive signs.

In order to make any kind of observation regarding possible breaches of intellectual or industrial property rights, as well as regarding any of the Contents of the Website, you may contact RocaJunyent by emailing dataprotection@rocajunyent.com and attaching the relevant information.

In any case, RocaJunyent accepts no responsibility whatsoever for any intellectual or industrial property rights owned by third parties that may be infringed by users of the website by any person other than RocaJunyent.

The Website may make available to you as a User technical linking devices (such as links, banners, buttons), which allow access to websites belonging to and/or managed by third parties ("Linked Sites"). The sole purpose of installing these links is to facilitate access to the information, content and services available on these Linked Sites. 

RocaJunyent does not offer or market by itself or through third parties the information, content and services available on the Linked Sites, nor does it previously control, approve, recommend, monitor or make them its own. RocaJunyent does not guarantee or assume any type of liability for damages of any kind that may be due to:

For this reason, as a User, you must exercise extreme caution in the evaluation and use of the information, content and services available on the linked channels, as well as any information of your own or of third parties that you wish to share on these channels.

The introduction of hyperlinks for the purpose of commercial exploitation on websites not belonging to RocaJunyent that allow access to this website without the authorisation of RocaJunyent is expressly prohibited. In order to improve the Website, RocaJunyent reserves the right, at any time and without prior notice, to modify, extend or temporarily suspend the presentation, configuration, technical specifications and services of the Website, unilaterally; as well as the right to modify at any time the Legal Terms of the Website which, in relation to the Website, have been or may be made available to you on the Website.

5. EXCLUSION OF LIABILITY

RocaJunyent does not guarantee the availability and continuity of the operation of the website, nor that it is free of errors. Whenever reasonably possible, RocaJunyent will give prior warning of any interruptions in the operation of the website. RocaJunyent excludes, to the full extent permitted by law, any liability for damages of any kind that may be due to the availability and continuity of access to the Website, such as technical, security, control, supply, etc. interruptions. It is incumbent upon you as a User of the Website, in any case, to have adequate tools for the detection and disinfection of harmful or damaging computer programmes.

As a User you are aware and voluntarily accept that the use of any of the contents of this Website takes place, in any case, under your sole and exclusive responsibility, and you must provide the necessary information in due time and form and following the guidelines and indications of the Website.

The website is not intended for underage Users.

In any case, RocaJunyent undertakes to try to solve any problems and/or incidents that may arise with the greatest possible diligence and to offer all the necessary support to the User in order, if necessary, to reach a rapid and satisfactory solution to the incident.

6. DATA PROTECTION

In accordance with the provisions of current legislation on Data Protection, all personal data provided during the use of the website will be treated in accordance with the provisions of the RocaJunyent Privacy Policy, which all users are aware of and accept when visiting our website.

7. LANGUAGE

RocaJunyent gives priority to its users and tries to address you whenever possible in your own language. For this reason, RocaJunyent has translated the Legal Terms of the Website into several languages. However, in the event of conflict or doubt as to the meaning or scope of any section, term or expression contained therein, the Spanish version shall take precedence, as it is the original version in which the Legal Terms of the Website have been drafted.

8. APPLICABLE LAW

The Legal Terms of the Website are governed in each and every one of its aspects by Spanish law. The Parties submit to the Courts and Tribunals of Barcelona, expressly waiving any other jurisdiction that may correspond to them, unless the applicable legislation requires another jurisdiction. Nevertheless, both parties will do everything reasonably necessary to try to resolve conflicts amicably.

Furthermore, in the event that you consider that your rights have been violated, in accordance with Regulation (EU) 524/2013 of the European Parliament and of the Council of 21 May 2013, Roca Junyent informs you that you have the right to resort to an online alternative dispute resolution procedure in consumer matters.
