15/05/2023
In an interview with Confilegal, Gerard Pérez, partner in the EU and Competition Law practice area, has highlighted several points about competition regulation in the EU and Spain, among them:
- Competition regulation in the EU. Gerard has pointed out that European regulation on free competition is in constant development. The European Commission seeks to adapt the main rules to the new times, the changing reality of markets and exceptional circumstances, such as the COVID-19 pandemic.
- Situation in Spain. The partner has stated that in general, Spain is at a fairly high level in the proper implementation of the basic European competition rules.
- Recent legislative successes. Gerard has highlighted the adaptation of the rules on commercial distribution agreements in Europe to the new market dynamics, especially the activity of online platforms and online commerce. The partner considers it a good move to remove restrictions on the use of the internet in the market, as long as they are justified to protect consumers. However, it mentions that the rules on commercial cooperation agreements between competitors have yet to be updated at EU level.
