José María Gimeno Feliú presents his new book: Hacia una buena administración desde la contratación pública (Towards a good administration from public procurement)
The book, published by Marcial Pons, proposes a paradigm shift in public procurement from a bureaucratic vision focused on price to a strategy based on value and results.
The Professor of Administrative Law and Of Counsel of RocaJunyent presented his new book at RocaJunyent's offices in Barcelona.
Barcelona, 5 February 2025. Yesterday, RocaJunyent hosted the presentation of the book Hacia una buena administración desde la contratación pública. De la cultura de la burocracia y el precio a la de la estrategia y el valor de los resultados (Towards good administration through public procurement. From a culture of bureaucracy and price to one of strategy and the value of results) at its offices in Barcelona. The book was written by José María Gimeno Feliú, Professor of Administrative Law at the University of Zaragoza and Of Counsel at RocaJunyent.
The event, co-organised by the Marcial Pons publishing house, was opened by Joan Roca Sagarra, Executive President of RocaJunyent, and included speeches by Juli Ponce Solé, Professor of Administrative Law at the University of Barcelona and Coordinator of the Law, Good Governance and Transparency Collection of the Marcial Pons publishing house, and Miquel Roca Junyent, Honorary President of the firm, who moderated the question and answer session with the author. The event was closed by the Secretary General of the Presidency of the Generalitat de Catalunya, Eva Giménez.
More than 70 people attended the presentation, including a significant number of institutional representatives, such as members of the Government of the Generalitat, Barcelona City Council, the Provincial Council, Chambers of Commerce, Professional Associations, the Judicial School, the Bar Association and the Competition Authority of Catalonia. The event was also attended by academics from various universities such as the University of Barcelona, the University of Zaragoza and the Autonomous University of Barcelona, and by a large group of business executives.
About the book
In Towards Good Administration through Public Procurement, José María Gimeno Feliú proposes a paradigm shift in public procurement, moving from a bureaucratic, price-centred vision to a strategy based on value and results. Through a detailed analysis of the regulations and their application, the author emphasises the need for public procurement to stop being a mere administrative procedure and become a strategic tool for improving public services and economic development.
The work also stands out for the importance it gives to adopting criteria of efficiency, sustainability and innovation in procurement processes, thus ensuring a positive impact both on the quality of the services provided and on strengthening the business fabric. With a practical approach based on real cases, the work offers essential keys for a more modern and transparent management, oriented towards obtaining social and economic benefits.
The author, José María Gimeno Feliú, stood out in his speech: ‘Public procurement is a key instrument for good administration and for the generation of public value. It is essential that we leave behind a merely formalistic vision and move towards a strategy that focuses on efficiency and the quality of results.’
Juli Ponce Solé, co-director of the Law, Good Governance and Transparency Collection of the Marcial Pons publishing house, of which this book is the tenth monograph published, emphasised in his presentation of the work that ‘quality public procurement is fundamental to the realisation of citizens’ right to good administration and the respect and protection of this right in procurement, in accordance with the abundant existing jurisprudence on the matter of the Court of Justice of the European Union and the Spanish Supreme Court, it is, in turn, essential to achieve good public management
Finally, Miquel Roca Junyent pointed out: ‘This book is a fundamental contribution to understanding public procurement as a management tool and not just a formality. It offers us a clear and necessary vision to achieve a modern and efficient administration.’
With this presentation, Roca-Junyent reaffirms his commitment to the dissemination of legal knowledge and to the debate on the major challenges of public procurement and administrative management in the public sphere and public-private partnerships.
