We have a team that is highly specialised in advising on public sector procurement, made up of attorneys who are experts in administrative law and in both public and private procurement.

We provide comprehensive advice to the entities that make up the public sector in the various stages of public procurement, assisting them in determining the most appropriate type of contract for the situation, choosing the procurement procedure, designing operations, preparing the contract file and the tender procedure with the drafting of specifications and the rest of the contract documents governing it, assisting in the processing of the procedure, awarding and signing of the contract, as well as in any aspect related to its execution. Likewise, we advise on the preparation of reports relating to the filing of special appeals in matters relating to contracting, contingencies arising in the execution or termination of contracts and enforcement of guarantees. Our advice also includes agreements, consortia and other collaboration instruments of public administrations and companies.

We also advise bidders and contractors on all issues that may arise in these procedures, such as the analysis of the bidding terms and specifications and their degree of compliance with applicable regulations. We assist in the preparation of bids, preparation of special resources for contracting or other remedies against all acts that may be appealed under public sector procurement regulations. Our practice also includes claims against the public sector in situations of late payment and contractual liability of any kind, obtaining and renewing the necessary classifications to contract with the public sector and registration in the official registers of bidders. Likewise, we advise in the constitution of joint ventures of companies or business group agreements for public tenders, planning and negotiation of economic-financial rebalances or contractual modifications, among others. 

We also advise on the different phases of the acquisition and sale processes of concessionaires and contractors in the public sector, as well as the assignment of contracts.

Our advice includes the legal management of all types of appeals before the courts in contentious-administrative cases, either as plaintiff, defendant or co-defendant and both private clients or public sector entities.

We advise our clients in all procedural situations included in the contentious-administrative jurisdiction and, therefore, in all judicial bodies, whether single-judge or collegiate courts (in Spain this usually means a bench of three judges). This advice also includes the negotiation of any transactional or contentious-administrative mediation agreements, as well as the execution of resolutions that put an end to judicial proceedings.
