GPT Chat and possible IPR infringements
Elisenda Perelló, Senior Intellectual Property Associate at RocaJunyent, has written this article published by El Economista which analyses the case in which the New York Times is suing OpenAI and Microsoft, alleging copyright infringement in the ChatGPT training system.
The newspaper claims that millions of its articles were used without permission to enhance ChatGPT's intelligence, resulting in the generation of verbatim excerpts of copyrighted content. This, according to the New York Times, affects its subscription and advertising revenue by providing unauthorised access to its content.
The lawsuit, filed in December 2023, discloses previous unsuccessful attempts to resolve the dispute amicably. In addition, other lawsuits against OpenAI are mentioned, including one by seventeen US authors and another by artists alleging copyright infringement in the creation of generative AI. To date, none of these lawsuits have been settled.
