New legal responsibilities for ‘influencers’

Elisenda Perelló, Senior Associate of RocaJunyent's Intellectual and Industrial Property Department, details in this article published in the newspaper Cinco Días, the approval of Royal Decree 444/2024 which regulates the requirements to be considered a user of special relevance in video sharing services, especially aimed at ‘influencers’ and content creators. The criteria include minimum income and significant audience on digital platforms, and those who comply must register in a state registry.

This regulation seeks to protect consumers and provide legal certainty to influencers, putting them on a par with other audiovisual professionals and ensuring respect for basic principles of audiovisual communication and the protection of the public, especially minors, from harmful content and advertising.
