Regulatory changes to promote socially responsible public procurement

Law 1/2026 of 8 April, published in the Official State Gazette (BOE) on 9 April 2026 and in force from the following day, addresses the need to update and strengthen the regulatory framework for the social economy in Spain. To this end, the legislation amends three key pieces of legislation: Law 9/2017 of 8 November on Public Sector Contracts (LCSP), Law 44/2007 of 13 December on the regulation of social integration enterprises, and Law 5/2011 of 29 March on the Social Economy.

Its main objective is to strengthen the integration of social criteria into public procurement, promoting the role of special employment centres of social initiative and integration enterprises as instruments for labour inclusion. To this end, it introduces significant changes in three areas: the increase in the minimum percentage of contracts subject to mandatory reservation, the obligation to include award criteria and special performance conditions linked to integration pathways, and the promotion of social clauses in public procurement in general.
