Good Corporate Governance of Commercial Companies and Compliance

Juan Cuenca, senior associate of the Commercial Department, publishes in LAW Criminal Compliance no. 3, October-December 2020, Editorial Wolters Kluwer, the article Good Corporate Governance of commercial companies and Compliance, which aims to review the historical evolution of the regulations on the corporate governance of capital companies, and especially during the last decade in Spain, since the reform of the Penal Code was approved; and, on the other hand, reflect on whether it is possible and, where appropriate, to what extent, to help directors overcome, through Compliance, hypegiaphobia or fear of decision making.
